Software Licence Agreement

End User Licence Agreement for The MAD software products.

End-User Licence Agreement (EULA)

This End-User Licence Agreement (“Agreement”) is a legal agreement between you (“Licensee”) and The MAD, The Marketers And Developers (“Licensor”) for the use of software products purchased from themad.in.

By installing, activating, or using any software product from The MAD, you agree to be bound by the terms of this Agreement.

1. Grant of Licence

  • The Licensor grants you a non-exclusive, non-transferable, revocable licence to install and use the software on the number of websites or installations specified in your purchased plan.
  • The licence is valid for the subscription period (typically 1 year) and renews upon payment of the renewal fee.
  • Free versions of our plugins are licensed under the GNU General Public Licence (GPL) v2 or later, as applicable.

2. Licence Types

  • Single-site licence: install and activate on one (1) WordPress website or application instance.
  • Multi-site licence: install and activate on the number of sites specified in your plan (e.g., 5-site, 25-site).
  • Unlimited licence: install on unlimited sites owned or operated by you.
  • SaaS licence: access to cloud-hosted software for the number of users or accounts specified in your subscription plan.

3. Permitted Use

You may:

  • Install and use the software on sites you own or manage for clients (within your licence limit).
  • Make backup copies of the software for your own use.
  • Modify the software for your own use (modifications are not covered by support).

4. Restrictions

You may NOT:

  • Redistribute, resell, lease, sublicence, or give away the pro/premium version of the software.
  • Share your licence key with third parties or publish it publicly.
  • Use the software on more sites than your licence permits.
  • Remove or alter copyright notices, branding, or licence verification mechanisms.
  • Use the software for any unlawful purpose.
  • Reverse-engineer the software except as permitted by applicable law.

5. Updates and Support

  • Active licence holders receive software updates (bug fixes, security patches, new features) for the duration of their subscription.
  • Support is provided via email for active licence holders. Response times are within 2 business days.
  • After your licence expires, you may continue using the last installed version but will not receive updates, support, or access to new features.
  • Renewal reactivates update and support access.

6. Intellectual Property

The software and all associated documentation, branding, and code are the intellectual property of The MAD. This Agreement does not transfer ownership. You receive only the licence rights described in this Agreement.

7. Data and Privacy

  • Our software may collect non-personal usage data (WordPress version, PHP version, active plugins) to improve compatibility and features. This can be opted out of in the plugin settings.
  • Licence verification requires periodic communication with our servers to validate your licence key.

8. Disclaimer of Warranties

The software is provided “AS IS” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free or uninterrupted.

9. Limitation of Liability

In no event shall The MAD be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the software. Our total liability shall not exceed the licence fee paid by you in the 12 months preceding the claim.

10. Termination

  • This Agreement is effective until terminated.
  • We may terminate your licence if you breach any term of this Agreement.
  • Upon termination, you must uninstall the software from all sites and destroy all copies.
  • You may terminate by uninstalling the software and discontinuing use.

11. Governing Law

This Agreement is governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Udaipur, Rajasthan, India.

12. Changes to This Agreement

We may update this Agreement from time to time. Changes will be posted on this page. Continued use of the software after changes constitutes acceptance of the updated terms.
